The California Trust Act effectively prohibits immigration officials from interviewing inmates jailed for lower-level offenses, or having them detained for possible deportation. The Priority Enforcement Program (PEP) program complies with the California Trust Act.

Basically, what does that mean? How can ICE determine if someone is eligible for the PEP program when The California Trust Act Prohibits interviews with ICE. This must be a critical thinking logic problem from one of the new common core programs.

The criminal conviction occurred a long time ago

There are “extenuating circumstances” involving the offense

There are “Humanitarian issues” such as age, health, pregnancy, having a young child or seriously sick relative in the states, or you have community ties

The person has family members living here

So, in retrospect; All of these Illegal felons meet the first criteria:

How many of these Illegal felons have a Family Member here.
The U.S. Immigration and Custom Enforcement (ICE) Enforcement and Removal Operations (ERO) officers who are in control of the process, have the authority to decide who is, or is not, deported.
